E-mail and mailing lists:

Sending unsolicited e-mail (SPAM), particularly commercial e-mail and bulk e-mail (addressed to multiple recipients) is prohibited. Automatic generation of mailing lists, or other inclusion of subscriber e-mail addresses in mailing lists without request or advance approval by the subscriber is prohibited. Mailing lists must be assembled by explicit opt-in by individual subscribers, and double opt-in is strongly recommended to anyone wishing to create and/or administer mailing lists. Mailing list administrators must retain adequate records to be able to demonstrate general compliance with this policy as well as evidence of specific opt-in of all subscribers, and must provide these records and evidence to OSO Technologies Staff in the course of abuse investigations. Opt-out-only mailing lists are explicitly prohibited to be used by OSO Technologies subscribers.. Mailing lists must be professionally administered and provide a reasonably responsive unsubscribe option, backed up (if automatic) by a reasonably responsive human list administrator. Forging of mail headers or otherwise obscuring or misrepresenting the origin of a message, either manually or via a mailer program, is prohibited. OSO Technologies reserves the right to block e-mail and other network traffic which originates from sites that habitually send or have recently sent unsolicited e-mail, or which permit e-mail to be relayed through them.

World Wide Web:

OSO Technologies reserves the right to refuse to provide World Wide Web publishing services using our servers and computers in cases where the content involved is judged to be salacious, explicitly erotic, or offensive. Customers purchasing transit services but not Web publishing services from OSO Technologies may establish whatever standards they feel are appropriate. Other prohibited content includes any illegal content as well as any content that supports or advocates violations of any clause of the AUP.

Violation of access or billing restrictions:

Violating or attempting to violate access and/or billing restrictions is prohibited.

Theft of service:

OSO Technologies subscribers are prohibited from using OSO Technologies services and resources to attempt or perform theft of services, whether these services are provided at OSO Technologies or elsewhere on a connected network, including the Internet. Theft of service includes but is not limited to: access violations (hacking/cracking), third-party e-mail relay (particularly bulk mailings), denial-of service attacks, and data theft. OSO Technologies maintains the right to block network traffic which originates from sites that probe or attack other systems on the Internet.

Leased lines:

Leased line and other transit service customers are contractually required to implement a similar acceptable use policy, and to make reasonable efforts to enforce it. Except where explicitly noted, all clauses of OSO Technologies’ AUP should be represented by a similar clause and/or policy in the subscriber’s AUP.

Other restrictions:

Users are prohibited from using OSO Technologies’ services and resources to engage in illegal activities. OSO Technologies will cooperate with properly authorized investigation and enforcement agents in the course of any investigation of criminal activities.

Penalties

Violations of the AUP by a subscriber may result in mandatory training for the purpose of explaining, enforcing and correcting violations. Other possible outcomes include discontinuance of service, cancellation of accounts without refund, assessment of fees for lost, stolen or misappropriated services, and assessment of legal fees and/or collection fees.

Other Policy Issues

Right to privacy:

OSO Technologies considers user-produced data stored on its servers or crossing its network to be the property of the subscriber who created it. The degree to which this content is made public is under the sole discretion of the creator. Contents of this data will not be reviewed, edited, archived without notice, replicated or otherwise investigated or altered in the normal course of business. OSO Technologies reserves the right to do so in the process of investigating system malfunction, resource abuse, illegal activities, or AUP violations.

Resale of collected data:

Demographic and personal data provided to OSO Technologies by subscribers will not be distributed, sold, or given to any other organization without prior notification of the individuals referred to by the data.

Editorial control:

OSO Technologies does not exercise editorial control over the content of e-mail, chat sessions, Usenet news postings, web pages, or other content produced by OSO Technologies subscribers. Subscribers are solely responsible for such content. Enforcement of OSO Technologies’ AUP is performed only after noncompliant content is brought to our attention; OSO Technologies exercises no proactive monitoring or editorial oversight at the time of content creation, publication or transmittal. OSO Technologies’ editorial oversight is restricted solely to company-generated, official content.

Liability limits:

OSO Technologies’ legal liability is strictly limited to items over which it retains editorial control.
